Unified Terms and Conditions for Using Haven Services<\/strong><\/h1>\n

Issued by Al Hatif Al Saree\u2019 for Import & Export \u2013 Haven<\/strong>
Hashemite Kingdom of Jordan<\/strong><\/p>\n

\n

Introduction<\/strong><\/h2>\n

This document constitutes the legally binding agreement between the user and Al Hatif Al Saree\u2019 for Import & Export \u2013 Haven.
Your use of the Haven application or its services constitutes explicit acceptance of all the terms and policies contained herein.
If you do not agree to any provision, you must immediately stop using the services.
The company reserves the right to amend the policies at any time, and such amendments become effective once published inside the application or on the website.<\/p>\n

\n

Clause (1): Contractual Relationship<\/strong><\/h1>\n

1.1<\/strong><\/h3>\n

These terms and conditions (\u201cUser Agreement\u201d) constitute the legally binding framework governing the user\u2019s relationship with Al Hatif Al Saree\u2019 for Import & Export \u2013 Haven, regarding the use of the application, the website, portable charging devices, or any service provided by the company directly or indirectly.<\/p>\n

1.2<\/strong><\/h3>\n

The term \u201cservices\u201d in this agreement includes everything provided by the company, including:
\u2022 The Haven application in all its versions
\u2022 The website havenjo.com
\u2022 Mobile charging stations
\u2022 Portable charging devices
\u2022 Rental and tracking systems
\u2022 Electronic payment services
\u2022 All types of content
\u2022 Technical support
\u2022 All accompanying digital functions, features, and tools<\/p>\n

1.3<\/strong><\/h3>\n

The user\u2019s use of the services constitutes explicit, final, and irrevocable acceptance of all the provisions of this agreement and forms a legally binding contract.<\/p>\n

1.4<\/strong><\/h3>\n

The company reserves the right to amend or update this agreement, entirely or partially, at any time it deems appropriate. Amendments become effective immediately upon their publication inside the application or on the website, and continued use constitutes full legal acceptance of such amendments.<\/p>\n

1.5<\/strong><\/h3>\n

This agreement cancels all previous agreements or understandings, written or verbal, related to the use of Haven\u2019s services.<\/p>\n

\n

Clause (2): Scope of Services<\/strong><\/h1>\n

2.1<\/strong><\/h3>\n

Haven provides an electronic and technological platform enabling the user to rent portable charging devices, use them, return them, pay the associated fees, and obtain technical support and supplementary services.<\/p>\n

2.2<\/strong><\/h3>\n

It is prohibited to use the services for any commercial purpose, to resell the charging devices, or to provide the service to others, unless prior written approval is obtained from the company.<\/p>\n

2.3<\/strong><\/h3>\n

The company commits to providing the service as much as possible; however, it does not guarantee the availability of devices at all stations or at all times.<\/p>\n

2.4<\/strong><\/h3>\n

The company does not provide any guarantee that the service will operate without interruption or delay, or that it is free from technical errors.<\/p>\n

\n

Clause (3): License<\/strong><\/h1>\n

3.1<\/strong><\/h3>\n

The company grants the user a limited, non-exclusive, non-transferable, and revocable license at any time, allowing them to use the application and access the services in accordance with these terms.<\/p>\n

3.2<\/strong><\/h3>\n

This license does not include any right to:
\u2022 Copy or reverse-engineer the application
\u2022 Decompile or modify the software codes
\u2022 Redistribute content or data
\u2022 Use the Haven trademark or any related elements without permission<\/p>\n

3.3<\/strong><\/h3>\n

The company retains all rights not expressly granted to the user.<\/p>\n

Clause (4): User Restrictions<\/strong><\/h1>\n

The user is strictly prohibited, under liability, from:<\/p>\n

4.1<\/strong><\/h3>\n

Attempting to decode, reverse engineer, or tamper with any part of the application, the system, or the charging stations.<\/p>\n

4.2<\/strong><\/h3>\n

Interfering with the operation of the services or attempting to bypass security systems.<\/p>\n

4.3<\/strong><\/h3>\n

Evading or attempting to evade the fee system or attempting to avoid payment.<\/p>\n

4.4<\/strong><\/h3>\n

Using the charging devices in violation of specifications, exposing them to liquids, or tampering with their components.<\/p>\n

4.5<\/strong><\/h3>\n

Using the services for illegal purposes or to harm the company or its customers.<\/p>\n

4.6<\/strong><\/h3>\n

Collecting or attempting to access data that the user is not authorized to view.<\/p>\n

4.7<\/strong><\/h3>\n

Engaging in any activity that may affect system stability or cause technical or financial damage.<\/p>\n

\n

Clause (5): Third-Party Services<\/strong><\/h1>\n

5.1<\/strong><\/h3>\n

Haven\u2019s services may contain content, tools, or services provided by third parties, including:
\u2022 Electronic payment services
\u2022 Cloud storage services
\u2022 Analytics systems
\u2022 Advertising services
\u2022 Error-tracking and performance tools<\/p>\n

5.2<\/strong><\/h3>\n

The use of such services is subject to the terms of use of their respective providers, and the company bears no responsibility for their actions or for the results of the user\u2019s interactions with them.<\/p>\n

5.3<\/strong><\/h3>\n

The company does not guarantee any content or service provided by any third party, nor any damages arising from the user\u2019s dealings with such entities.<\/p>\n

\n

Clause (6): Intellectual Property<\/strong><\/h1>\n

6.1<\/strong><\/h3>\n

All intellectual property rights related to the application and the website \u2014 including software codes, databases, designs, the Haven trademark, textual and visual materials, operational structure, and algorithms \u2014 are the exclusive property of the company.<\/p>\n

6.2<\/strong><\/h3>\n

It is strictly prohibited to use any of the intellectual property elements for any purpose without prior written authorization.<\/p>\n

6.3<\/strong><\/h3>\n

Any violation of intellectual property rights exposes the user to civil and criminal liability under Jordanian law.<\/p>\n

\n

Clause (7): Maintenance of Charging Devices and Inspection Responsibility<\/strong><\/h1>\n

7.1<\/strong><\/h3>\n

The company is responsible for maintaining the charging stations and portable charging devices, including inspecting and periodically replacing batteries, without being obligated to guarantee the availability of fully functional devices at all times.<\/p>\n

7.2<\/strong><\/h3>\n

The user must inspect the charging device before use, including ensuring that:
\u2022 The cable is intact
\u2022 There is no visible damage
\u2022 There is no abnormal heat
\u2022 The device is not wet<\/p>\n

7.3<\/strong><\/h3>\n

If the user discovers any defect, they must immediately stop using the device and notify customer support.<\/p>\n

7.4<\/strong><\/h3>\n

The user bears full responsibility for any damage resulting from ignoring signs of malfunction.<\/p>\n

\n

Clause (8): Accounts<\/strong><\/h1>\n

8.1<\/strong><\/h3>\n

Creating a user account requires an active phone number, and the account serves as the user\u2019s digital identity within the system.<\/p>\n

8.2<\/strong><\/h3>\n

The user must provide accurate information, and the company has the right to suspend the account or stop service if incorrect data is provided.<\/p>\n

8.3<\/strong><\/h3>\n

The user bears full responsibility for any activity carried out through their account.<\/p>\n

8.4<\/strong><\/h3>\n

Sharing the account with any other party is strictly prohibited, as is using the account for unauthorized rental activities.<\/p>\n

8.5<\/strong><\/h3>\n

The company may request identity verification when necessary and may refuse service if the user does not comply.<\/p>\n

\n

Clause (9): User Conduct<\/strong><\/h1>\n

9.1<\/strong><\/h3>\n

The user must use the charging devices in a safe and lawful manner.<\/p>\n

9.2<\/strong><\/h3>\n

It is prohibited to:
\u2022 Tamper with charging stations
\u2022 Take the device without completing rental procedures
\u2022 Attempt to steal or hide the device
\u2022 Use the device for dangerous purposes
\u2022 Intentionally damage the device or station
\u2022 Publish or share offensive content through the company\u2019s platforms<\/p>\n

9.3<\/strong><\/h3>\n

The company has the right to:
\u2022 Suspend the user\u2019s account
\u2022 Terminate the agreement
\u2022 Impose financial penalties
\u2022 Take legal action
in the event of any violation by the user.<\/p>\n

\n

Clause (10): SMS Messages<\/strong><\/h1>\n

10.1<\/strong><\/h3>\n

By creating an account, the user agrees to receive SMS messages and notifications related to:
\u2022 Account verification
\u2022 Starting or ending the rental
\u2022 Payment notifications
\u2022 Security alerts
\u2022 Operational notices<\/p>\n

10.2<\/strong><\/h3>\n

It is not possible to disable messages related to security, billing, or essential operations. Marketing messages may only be turned off through procedures specified by the company.<\/p>\n

\n

Clause (11): Promotional Codes \u2013 Promo Codes<\/strong><\/h1>\n

11.1<\/strong><\/h3>\n

The company may provide promotional codes (\u201cPromo Codes\u201d) that allow the user to obtain discounts, benefits, or limited offers under special conditions determined separately by Haven for each campaign.<\/p>\n

11.2<\/strong><\/h3>\n

The user is prohibited from using promotional codes in any manner that constitutes misuse, including \u2014 but not limited to:
\u2022 Sharing codes improperly
\u2022 Selling codes
\u2022 Attempting to generate unofficial codes
\u2022 Using codes intended for a specific user by others
\u2022 Exploiting system loopholes to obtain undeserved benefits<\/p>\n

11.3<\/strong><\/h3>\n

The company reserves the full right to cancel or revoke any promotional code used improperly, fraudulently, or in violation of the campaign conditions.<\/p>\n

11.4<\/strong><\/h3>\n

No promotional code may be exchanged for cash, and the user may not claim its monetary value or rely on any rights after its expiration.<\/p>\n

11.5<\/strong><\/h3>\n

The promotional code policy is considered an integral part of this agreement and is subject to all of its provisions.<\/p>\n

\n

Clause (12): Network Connectivity<\/strong><\/h1>\n

12.1<\/strong><\/h3>\n

The user is responsible for providing an active internet connection while using the application, whether through:
\u2022 Mobile data
\u2022 Wi-Fi networks
\u2022 Any other communication method<\/p>\n

12.2<\/strong><\/h3>\n

The company does not guarantee that the application will operate on all devices, versions, or operating systems, as performance depends on the technical environment of the user\u2019s device.<\/p>\n

12.3<\/strong><\/h3>\n

Certain functions \u2014 such as starting a rental, ending a rental, device tracking, payments, and geolocation \u2014 may be affected by weak connectivity, and the company bears no responsibility for any harm or delay arising from this.<\/p>\n

12.4<\/strong><\/h3>\n

Internet outages or lack of network availability are not considered the company\u2019s responsibility.<\/p>\n

\n

Clause (13): Account Deletion<\/strong><\/h1>\n

13.1<\/strong><\/h3>\n

The user has the right to request deletion of their account through the application (if available) or by contacting the company via its official email.<\/p>\n

13.2<\/strong><\/h3>\n

Deleting the account does not remove any outstanding financial obligations owed by the user, including:
\u2022 Unpaid rental fees
\u2022 Lost device fees
\u2022 Any applicable penalties<\/p>\n

13.3<\/strong><\/h3>\n

The company reserves the right to retain certain records in accordance with legal requirements, including payment records and rental logs.<\/p>\n

13.4<\/strong><\/h3>\n

Processing the deletion request may take time depending on the company\u2019s internal procedures.<\/p>\n

\n

Clause (14): System Operation<\/strong><\/h1>\n

14.1<\/strong><\/h3>\n

The rental period begins exclusively at the moment the user presses the \u201cStart Rental\u201d button inside the application or when scanning the QR code correctly. No time is counted before that.<\/p>\n

14.2<\/strong><\/h3>\n

The device remains under the user\u2019s responsibility until the return is successfully registered inside an authorized Haven charging station.<\/p>\n

14.3<\/strong><\/h3>\n

The user may keep the device for any duration if accumulated rental fees are paid in accordance with the pricing system.<\/p>\n

14.4<\/strong><\/h3>\n

If payment fails 24 hours after the rental starts, the company will attempt to charge the amount again within 48 hours.<\/p>\n

14.5<\/strong><\/h3>\n

If repeated charging attempts fail and the user\u2019s behavior indicates intent to evade or avoid returning the device, the company may classify the device as \u201clost\u201d and apply the lost-device fee.<\/p>\n

14.6<\/strong><\/h3>\n

The user is responsible for ensuring that the device is correctly returned. Any failure to properly return the device is not borne by the company unless a confirmed technical malfunction exists.<\/p>\n

\n

Clause (15): Payment Terms<\/strong><\/h1>\n

15.1 \u2013 Approved Pricing System<\/strong><\/h3>\n

\u2022 First hour: 1 Jordanian Dinar
\u2022 Second hour: 0.5 Jordanian Dinar
\u2022 From the third hour up to 24 hours: 1.5 Jordanian Dinars
\u2022 Each additional 24 hours: 3 Jordanian Dinars
\u2022 Security deposit: 5 Jordanian Dinars (deducted at rental start)
\u2022 Lost device fee: 25 Jordanian Dinars
\u2022 Prices include applicable taxes, unless otherwise stated.<\/p>\n

15.2<\/strong><\/h3>\n

Charges are deducted automatically from:
\u2022 The user\u2019s digital wallet balance
\u2022 If insufficient, the registered payment card<\/p>\n

15.3<\/strong><\/h3>\n

Payments are processed through an authorized electronic payment service provider, and Haven does not store card data on its servers.<\/p>\n

15.4<\/strong><\/h3>\n

All transactions are processed in Jordanian Dinars and may take 1\u20135 business days to appear on the card statement.<\/p>\n

15.5<\/strong><\/h3>\n

The company has the right to retry charging outstanding fees automatically until settled, within legal boundaries.<\/p>\n

\n

Clause (16): Device Usage<\/strong><\/h1>\n

16.1<\/strong><\/h3>\n

The user undertakes to use the charging device safely and in accordance with the company\u2019s instructions.<\/p>\n

16.2<\/strong><\/h3>\n

The user is strictly prohibited from:
\u2022 Attempting to open the device
\u2022 Exposing the device to liquids
\u2022 Exposing the device to high heat
\u2022 Dropping, damaging, or mishandling the device
\u2022 Using the device for harmful or dangerous purposes
\u2022 Taking the device outside the service area without ending the rental<\/p>\n

16.3<\/strong><\/h3>\n

The user bears full responsibility for any damage resulting from misuse.<\/p>\n

\n

Clause (17): Declarations<\/strong><\/h1>\n

17.1<\/strong><\/h3>\n

The user acknowledges that they are legally capable of using the services and that all information provided is accurate.<\/p>\n

17.2<\/strong><\/h3>\n

The user agrees to bear all legal and financial responsibilities resulting from their use of the device or the application.<\/p>\n

17.3<\/strong><\/h3>\n

The user undertakes not to use the services in any manner that exposes themselves, others, or the company to any security, financial, or legal risk.<\/p>\n

\n

Clause (18): Acknowledgments<\/strong><\/h1>\n

18.1<\/strong><\/h3>\n

The user acknowledges and understands that:
\u2022 The charging devices are not insured
\u2022 Device availability at stations is not always guaranteed
\u2022 The service may be affected by technical factors beyond the company\u2019s control
\u2022 Collected data may be used to improve service performance<\/p>\n

18.2<\/strong><\/h3>\n

The company bears no responsibility for any malfunction outside its control, including:
\u2022 Power outages
\u2022 Weak internet connection
\u2022 Device failures on the user’s side<\/p>\n

\n

Clause (19): Usage Requirements<\/strong><\/h1>\n

19.1<\/strong><\/h3>\n

The user must inspect the device before use and immediately report any technical issue.<\/p>\n

19.2<\/strong><\/h3>\n

The user must comply with safety instructions and proper usage practices.<\/p>\n

19.3<\/strong><\/h3>\n

Any prohibited or improper usage that may damage the device or impair its performance is not allowed.<\/p>\n

\n

Clause (20): Dispute Resolution<\/strong><\/h1>\n

20.1<\/strong><\/h3>\n

This agreement is governed and interpreted in accordance with the laws and regulations of the Hashemite Kingdom of Jordan.<\/p>\n

20.2<\/strong><\/h3>\n

The courts of Amman shall have exclusive jurisdiction to hear any dispute arising from the interpretation, application, or execution of these terms.<\/p>\n

20.3<\/strong><\/h3>\n

The company and the user agree to attempt amicable resolution of disputes whenever possible before resorting to legal action.<\/p>\n

\n

Clause (21): Indemnification<\/strong><\/h1>\n

21.1<\/strong><\/h3>\n

The user undertakes to compensate the company for any losses, damages, claims, or costs \u2014 including attorney fees \u2014 arising from any of the following:
\u2022 Misuse of charging devices
\u2022 Violation of this agreement
\u2022 Breach of any applicable law or regulation
\u2022 Damage to charging stations or devices
\u2022 Loss or destruction of the device
\u2022 Any fraudulent or unlawful behavior<\/p>\n

21.2<\/strong><\/h3>\n

Indemnification includes all direct and indirect damages incurred by the company as a result of the user\u2019s actions.<\/p>\n

21.3<\/strong><\/h3>\n

The company\u2019s right to request compensation remains valid even after termination of the agreement.<\/p>\n

\n

Clause (22): Assignment<\/strong><\/h1>\n

22.1<\/strong><\/h3>\n

The company may, at its sole discretion, transfer or assign any of its rights or obligations under this agreement to any other party, including:
\u2022 A subsidiary company
\u2022 An acquiring entity
\u2022 A business partner
\u2022 Any other legal entity<\/p>\n

22.2<\/strong><\/h3>\n

The user may not assign any of their rights or obligations without prior written consent from the company.<\/p>\n

\n

Clause (23): No Waiver<\/strong><\/h1>\n

23.1<\/strong><\/h3>\n

The company\u2019s failure to enforce any provision of this agreement at any time does not constitute a waiver of its right to enforce it later.<\/p>\n

23.2<\/strong><\/h3>\n

Any delay or leniency by the company in taking legal action does not constitute a waiver of its rights.<\/p>\n

\n

Clause (24): Termination<\/strong><\/h1>\n

24.1<\/strong><\/h3>\n

The company may, without prior notice, terminate, suspend, or restrict the user\u2019s access to the application in any of the following cases:
\u2022 Misuse of the service
\u2022 Providing incorrect information
\u2022 Failure to pay outstanding amounts
\u2022 Violations of Jordanian laws
\u2022 Attempting to tamper with charging devices
\u2022 Using the application for illegal purposes<\/p>\n

24.2<\/strong><\/h3>\n

The user remains obligated to pay all outstanding amounts even after termination.<\/p>\n

24.3<\/strong><\/h3>\n

The company may take legal action if damage or fraud is confirmed.<\/p>\n

\n

Clause (25): Survival<\/strong><\/h1>\n

25.1<\/strong><\/h3>\n

The following clauses remain valid and binding after termination:
\u2022 Unpaid fees
\u2022 Indemnification
\u2022 Intellectual property
\u2022 Limitation of liability
\u2022 Dispute resolution
\u2022 Any outstanding financial obligations<\/p>\n

25.2<\/strong><\/h3>\n

Termination does not relieve the user from any prior responsibilities.<\/p>\n

\n

Clause (26): Data Protection<\/strong><\/h1>\n

26.1<\/strong><\/h3>\n

The company processes user data in accordance with the Privacy Policy published within the application.<\/p>\n

26.2<\/strong><\/h3>\n

The data processed includes:
\u2022 Phone number
\u2022 User location (when permitted)
\u2022 Payment information
\u2022 Rental records
\u2022 Device identifier
\u2022 Technical and analytical data<\/p>\n

26.3<\/strong><\/h3>\n

Data may be shared only with authorized service providers to the extent necessary for operating the service.<\/p>\n

26.4<\/strong><\/h3>\n

The company is committed to protecting data using advanced technical and security standards.<\/p>\n

\n

Clause (27): Updating Information<\/strong><\/h1>\n

27.1<\/strong><\/h3>\n

The user must update their information immediately upon any change, including:
\u2022 Phone number
\u2022 Payment details
\u2022 Personal information required for account operation<\/p>\n

27.2<\/strong><\/h3>\n

Failure to update information may result in:
\u2022 Interruption of certain application services
\u2022 Payment failures
\u2022 Account suspension<\/p>\n

27.3<\/strong><\/h3>\n

The company bears no responsibility for any consequences resulting from inaccurate information.<\/p>\n

Clause (28): Data Processing<\/strong><\/h1>\n

28.1<\/strong><\/h3>\n

The company processes data for the following purposes:
\u2022 Operating the service
\u2022 Issuing invoices
\u2022 Account verification
\u2022 Legal compliance
\u2022 Fraud prevention
\u2022 Performance enhancement<\/p>\n

28.2<\/strong><\/h3>\n

The company may use technical data to develop new services and improve user experience.<\/p>\n

28.3<\/strong><\/h3>\n

Data will not be shared with any party outside the legal framework or without clear authorization.<\/p>\n

It is the user’s responsibility to review the terms of external parties before interacting with them.<\/p>\n

The application may display advertisements or promotional offers from external parties.<\/p>\n

30.2<\/strong><\/h3>\n

Non-personal analytical data may be shared with advertising providers for:

\u2022 Evaluating campaign performance
\u2022 Enhancing user experience<\/p>\n

30.3<\/strong><\/h3>\n

No direct personal data is shared with advertisers.<\/p>\n

30.4<\/strong><\/h3>\n

The company bears no responsibility for any advertising content provided by third parties.<\/p>\n

Clause (31): User Responsibility with Third Parties<\/strong><\/h1>\n

The user acknowledges that any interaction between them and third parties \u2014 whether through links, applications, or embedded services within the application \u2014 is solely at their own responsibility.<\/p>\n

The company does not guarantee:
\u2022 The accuracy or correctness of third-party content
\u2022 The safety of any offers provided by them
\u2022 Their compliance with any legal or technical standards<\/p>\n

31.3<\/strong><\/h3>\n

The user bears full responsibility for verifying:
\u2022 The authenticity of links
\u2022 The identity of the service provider
\u2022 The third party\u2019s terms and conditions
\u2022 Any potential risks involved in sharing their data with them<\/p>\n

31.4<\/strong><\/h3>\n

The company disclaims any liability for any direct or indirect harm resulting from the use of third-party services.<\/p>\n

Clause (32): Customer Support<\/strong><\/h1>\n

The company provides customer support channels, including:

The company commits to making reasonable efforts to respond to user inquiries within a suitable timeframe according to internal procedures and system capabilities.<\/p>\n

32.3<\/strong><\/h3>\n

Some cases may require identity or account verification before assistance is provided.<\/p>\n

\n

Clause (33): Disclaimer<\/strong><\/h1>\n

33.1<\/strong><\/h3>\n

Haven\u2019s services, features, and devices are provided \u201cAS IS,\u201d without any express or implied warranties, including but not limited to:
\u2022 Warranties of uninterrupted service
\u2022 Warranties that devices are free of defects
\u2022 Warranties of fitness for a particular purpose
\u2022 Guarantees that charging stations will always be available
\u2022 Guarantees that the application is compatible with all devices<\/p>\n

33.2<\/strong><\/h3>\n

The service may be affected by external factors beyond the company\u2019s control, such as:
\u2022 Weak internet connectivity
\u2022 Telecom network failures
\u2022 Technical or environmental conditions

The company is not liable for any of the following:
\u2022 Financial losses
\u2022 Loss of data
\u2022 Damage to the user\u2019s device
\u2022 Delays
\u2022 Service interruptions caused by internet outages
\u2022 Misuse by the user or any third party
\u2022 Loss of the charging device due to the user
\u2022 Accidents caused by heat, liquids, disassembly, or tampering<\/p>\n

34.2<\/strong><\/h3>\n

The maximum legal liability that may be imposed on the company \u2014 and only in the case of proven direct fault \u2014 shall not exceed the amount paid by the user for the rental transaction in dispute.<\/p>\n

34.3<\/strong><\/h3>\n

The company bears no responsibility for:
\u2022 Indirect damages
\u2022 Special, punitive, or consequential damages
\u2022 Loss of profits
\u2022 Loss of data
\u2022 Any damages resulting from unlawful or improper use<\/p>\n

34.4<\/strong><\/h3>\n

These provisions shall be interpreted in a manner that does not conflict with applicable Jordanian laws.<\/p>\n

Clause (35): Additional Compensation<\/strong><\/h1>\n

The company\u2019s right to compensation includes:
\u2022 Repair or replacement costs
\u2022 Lost-device fees
\u2022 Investigation expenses
\u2022 Legal costs
\u2022 Any losses incurred due to the user\u2019s violation<\/p>\n

The company may take legal action to recover its dues in accordance with Jordanian law.<\/p>\n

Clause (36): Governing Law<\/strong><\/h1>\n

This agreement \u2014 with all its provisions and details \u2014 is governed by the laws and regulations of the Hashemite Kingdom of Jordan.<\/p>\n

The courts of Amman shall have exclusive jurisdiction over any dispute arising from the interpretation, application, or enforcement of this agreement.<\/p>\n

The company may send notifications through:

\u2022 Text messages
\u2022 Email (when added in the future)
\u2022 Payment alerts

Notifications may include:
\u2022 Verification messages
\u2022 Rental expiration alerts
\u2022 Payment reminders
\u2022 Updates to terms and policies
\u2022 Security alerts
\u2022 Reminders to return the device<\/p>\n

37.3<\/strong><\/h3>\n

The user may not disable essential notifications related to security or billing.<\/p>\n

Clause (38): General Provisions<\/strong><\/h1>\n

Using the application does not establish any of the following relationships between the user and the company:
\u2022 Partnership
\u2022 Agency
\u2022 Employment
\u2022 Franchise<\/p>\n

38.2<\/strong><\/h3>\n

If any provision becomes unenforceable, the remaining provisions shall remain valid and effective.<\/p>\n

38.3<\/strong><\/h3>\n

Force majeure events exempt the company from obligations during:
\u2022 Natural disasters
\u2022 National emergencies
\u2022 Major outages
\u2022 Pandemics
\u2022 Circumstances beyond control<\/p>\n

The version published within the application is considered the binding and official version.<\/p>\n

Clause (39): Intellectual Property<\/strong><\/h1>\n

All intellectual property rights belong to Al Hatif Al Saree\u2019 for Import & Export, including:
\u2022 The \u201cHaven\u201d trademark
\u2022 Design assets
\u2022 Software
\u2022 Source code
\u2022 Textual and visual content
\u2022 Application structure
\u2022 Database
\u2022 Algorithms
\u2022 Technologies used
\u2022 All materials published through the website and application<\/p>\n

39.2<\/strong><\/h3>\n

The user is prohibited from:
\u2022 Copying or republishing any content
\u2022 Using the trademark without permission
\u2022 Tampering with the software
\u2022 Attempting to extract source code
\u2022 Reproducing the database
\u2022 Any unauthorized commercial use<\/p>\n

39.3<\/strong><\/h3>\n

The company reserves the right to take legal action against any violation.<\/p>\n

Clause (40): Unauthorized Payments<\/strong><\/h1>\n

40.1<\/strong><\/h3>\n

The company may suspend the user\u2019s account if it suspects any unusual or unauthorized transaction.<\/p>\n

40.2<\/strong><\/h3>\n

The company may take additional actions, including:
\u2022 Requesting identity verification
\u2022 Disabling the payment method
\u2022 Contacting the payment service provider
\u2022 Investigating the source of the transaction<\/p>\n

40.3<\/strong><\/h3>\n

The company reserves the right to protect the system from any attempt at unauthorized use.<\/p>\n

Clause (41): Lost Device<\/strong><\/h1>\n

41.1<\/strong><\/h3>\n

The charging device is considered \u201clost\u201d in any of the following cases:
\u2022 Failure to return the device for an extended period with accumulating rental fees
\u2022 Payment failure after 24\u201348 hours from rental start
\u2022 Ignoring repeated reminder notifications
\u2022 Behavior indicating intent to evade or retain the device unlawfully
\u2022 Inability to track the device or loss of technical signals
\u2022 Indications of tampering with the device or disabling sensors<\/p>\n

41.2<\/strong><\/h3>\n

When a device is classified as lost, a lost-device fee of 25 Jordanian Dinars is applied, in addition to any accumulated rental charges.<\/p>\n

41.3<\/strong><\/h3>\n

The lost-device fee may only be waived if there is clear legal evidence of a technical or system error for which the user is not responsible.<\/p>\n

41.4<\/strong><\/h3>\n

The user remains responsible for the device until it is physically returned to an authorized charging station.<\/p>\n

Clause (42): Damages & Compensation<\/strong><\/h1>\n

42.1<\/strong><\/h3>\n

Rental fees continue to accumulate until the device is properly returned to an authorized station.<\/p>\n

42.2<\/strong><\/h3>\n

The user bears the cost of repairing any damage caused to the device or station due to misuse or negligence.<\/p>\n

42.3<\/strong><\/h3>\n

Lost-device fees are non-refundable and cannot be canceled except in legally proven cases involving system or technical failure attributable to the company.<\/p>\n

42.4<\/strong><\/h3>\n

The company may issue a detailed invoice outlining the fees and amounts due for any damages. The lost device fee does not exempt the user from returning the device if later found.<\/p>\n

Clause (43): Wallet Top-Up<\/strong><\/h1>\n

Continued rental may require the user to maintain a sufficient balance in their in-app wallet.<\/p>\n

Wallet top-ups are final and non-refundable in cash, except in specific legal circumstances.<\/p>\n

43.3<\/strong><\/h3>\n

Wallet credit may only be used for:
\u2022 Rental payments
\u2022 Settling outstanding fees
\u2022 Future in-app services<\/p>\n

43.4<\/strong><\/h3>\n

Wallet credit cannot be used outside the application.<\/p>\n

Clause (44): Refund Policy<\/strong><\/h1>\n

Rental fees are non-refundable once the rental has begun.<\/p>\n

The user may request a refund in cases of technical errors or incorrect charges, provided that the request is submitted within 48 hours.<\/p>\n

The company reviews refund requests within 1\u201314 days.<\/p>\n

Refunds are issued through the same payment method originally used.<\/p>\n

The company may modify prices at any time, and the changes take effect once published inside the application.<\/p>\n

Prices may vary depending on:
\u2022 Geographic location
\u2022 Operational costs
\u2022 Commercial agreements with hosting partners<\/p>\n

A rental cannot be canceled once it has begun.<\/p>\n

The company does not store payment card information on its servers.<\/p>\n

\u2022 Cyberattacks

The device must be returned to any authorized station within the Haven network.<\/p>\n

48.4<\/strong><\/h3>\n

The company does not offer manual delivery, pickup services, or couriers.<\/p>\n

Clause (49): User Acceptance<\/strong><\/h1>\n

By using Haven\u2019s services or beginning a rental, the user expressly acknowledges and agrees to:

The user acknowledges that the Privacy Policy published on havenjo.com is an integral part of this agreement.<\/p>\n

Continued use of the service constitutes renewed acceptance of any future updates.<\/p>\n

This agreement represents the complete legal framework governing the relationship between the user and Haven. It constitutes the sole officially recognized reference and supersedes any prior agreements or communications \u2014 whether written or oral \u2014 relating to the use of the application\u2019s services.<\/p>\n
